As a state agency, a sign off acknowledging that a backround check 
will be made is included in our application.  Additionally, all 
employees must pay to have fingerprints taken.  These are kept in 
"search and retain" so that the (in my case) seasonal employees don't 
have to go thru this year after year.  They only pay once.  But, if 
there is an interuption say they don't return next summer and then 
reapply for 2009, the process begins again.

On our application, there is also 2 sep places that ask about any 
violations, mis meanders etc.  They are also verbally asked at the 
interviews.  Before they sign the application they are aware that 
should anything come up, policy states that we can not hire them.  
But, they may reapply 6 weeks later.

Should they tell personnel what discretions there are in their past, 
then it is confirmed from the back ground check, personel decides if 
it has any effect on the job they are applying for.  If not, they may 
be hired.
